Beta Testing Terms

Last updated 21 September 2026

These terms govern your taking part in the closed beta test of the Little Stomp Club app. They are between you and Brightlobe Limited. By accepting a TestFlight invitation or installing a beta build, you accept them, for yourself and on behalf of the child who will play.

Two other documents go with this one. The App Terms of Service govern the app itself and apply to you in full. The Beta Privacy Policy explains what we do with personal data. If this document and the App Terms of Service disagree about something specific to the beta, this one wins.

1. Who we are

2. Who can take part

To be a tester you must:

A child cannot join, agree to anything, or be a tester. Every decision here is yours. If you are not the child's parent or guardian, stop and do not install the build.

Places are limited and at our discretion. We can decline anyone, and we do not have to say why.

3. What a beta is

This is unfinished software that we are giving you early precisely so that you can find what is wrong with it. You should expect it to be rough. Specifically:

You will also see a membership screen. It is there so that we can test it. Nothing can be bought during the beta, purchasing is switched off, and you have access to everything the build contains at no cost. If that ever changes we will tell you before it does.

The beta is provided free and "as is". Nothing we say about features, timing or release is a promise. Please do not rely on it, and please do not make it the only game on the device if that would upset anybody.

4. What it costs, and what you get

Nothing, in both directions. Taking part is free. You are not paid, and testing is not work, employment, a contract for services, a partnership or a joint venture. Taking part does not entitle you to a free or discounted copy of the finished game, to early access to anything else, to a credit, or to any share in what we make.

If we ever want to thank testers with something, we will offer it separately and you will be free to decline.

5. Your licence to the beta build

We grant you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to install and use the beta build, on devices you control, in your own household, for the sole purpose of testing it and giving us feedback, for as long as the beta runs.

You must not:

Everything in the build, including the code, artwork, characters, dinosaurs, music, sound and words, stays ours. Nothing here transfers any of it to you.

6. Keeping it to yourself

The beta is confidential. Until we publicly release the game or announce the thing in question ourselves, please do not:

You may of course talk to your own household, and to us, as much as you like. You may say that you are testing a Brightlobe game if you want to. This obligation ends for any particular thing once we have made it public ourselves, or if it becomes public through no fault of yours, or if you are legally required to disclose it, in which case please tell us first if you are allowed to.

This section survives the end of your participation.

7. Your feedback

Feedback is the whole point, and we want it blunt. When you send us feedback, bug reports, ideas, suggestions or recordings of your own observations:

Please do not send us anything you want to keep or be paid for. This section is not about recordings of your child, which are governed by section 8 and by the Beta Privacy Policy, and which we do not own.

8. Observed sessions and recordings

We may invite you to a session where we watch your child play, in person or over a video call, and we may ask to record it.

You keep whatever rights you and your child have in the recording. You grant us only a limited licence to hold and watch it internally for the purpose described, which ends when you withdraw consent or when our retention period runs out.

9. Supervising your child

You are responsible for your child's use of the build. That means:

Little Stomp Club is a game. It is not an educational programme, a diagnostic tool, a therapy, or a developmental assessment, and nothing in it is advice of any kind. If you have any concern about your child's development, speak to a health visitor, GP or other professional.

Beta software is less predictable than finished software. Please take a little more care than usual, not less.

10. Apple's part in this

The beta is distributed through Apple's TestFlight, and your use of TestFlight is governed by Apple's own terms and privacy policy, which are between you and Apple. Apple is not a party to these terms, has no responsibility for the build or for anything we do, and provides no support or warranty for it. Section 12 of the App Terms of Service sets out the Apple provisions in full, and they apply to the beta too.

11. Leaving, and being asked to leave

You can leave whenever you like, for any reason or none. Delete the build, and email us so we stop writing to you. Nothing is owed either way.

We can end your participation at any time, with or without notice, and we will normally say why. We would expect to do so if you break these terms, share the build, publish it, or do something that puts a child at risk.

When participation ends, your licence ends with it. Please delete the build from every device. Sections 5 (ownership), 6, 7, 12 and 13 survive.

12. What we are and are not responsible for

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. Your statutory rights as a consumer are not affected, including under the Consumer Rights Act 2015 and, in the United States, under any law of your state that gives you rights we cannot sign away.

Beyond that, and to the fullest extent the law allows:

We ask you to install the build on a device you are comfortable installing unfinished software on, and to back up anything on it that matters to you.

13. General

14. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you may bring proceedings in your own jurisdiction. If you are a consumer resident in the United States, nothing here deprives you of the protection of the mandatory consumer laws of your state of residence, or of your right to bring a claim where those laws allow.
