App Terms of Service
Last updated 21 September 2026
These terms are the agreement between you and Brightlobe Limited for the Little Stomp Club app. They apply whether you have the app through the closed beta or, in time, from the App Store. By installing or using the app you accept them, for yourself and on behalf of the child who plays.
While the app is in closed beta, the Beta Testing Terms also apply and take precedence on anything specific to testing. The Beta Privacy Policy explains what we do with personal data. In short: nothing in the app measures or profiles your child, and the only two services it contacts are described there.
1. Who we are

Little Stomp Club is a Brightlobe product. Its name and logo are provisional while a trade mark application is pending.
2. Who may accept these terms
You must be 18 or over and legally able to enter a contract. The app is designed for children of roughly three to five, but a child cannot agree to these terms and is not a party to them. An adult must install the app, accept these terms, and remain responsible for how it is used.
If you are installing it for a child in your professional care rather than your own household, see section 6 about commercial use, and contact us first.
3. Your licence
We grant you a personal, limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to download and use the app on devices you own or control, for the private, non-commercial enjoyment of your household. Apple's Usage Rules apply to that licence as described in section 12.
You are buying nothing and owning nothing. The app is licensed to you, not sold.
4. What the app does, and does not, do
- Play is stored on the device. Progress and settings never leave it, and deleting the app deletes them. The app goes online for one thing only: checking whether this device has a membership. Crash reports go to Apple, not to any service of ours. Our Beta Privacy Policy describes both in full.
- No accounts. There is nothing to register, log into, or recover.
- No advertising. No ads, no ad networks, no tracking, no ad identifier.
- A paid membership unlocks some of the games, bought through Apple's checkout. Nothing can be bought during the beta. Section 5 sets out how it works.
- No chat, no sharing, no links out. There is no way for anyone to contact your child through the app.
- No analytics. Nothing measures what your child does in the game, and nothing profiles them.
If any of that ever changes in a future version, we will say so here and in the App Store listing before the version ships, and where the law requires consent we will ask for it rather than assume it.
5. The membership, and paying for it
Some of the games are free and some are part of a paid membership. The membership is an auto-renewing subscription sold by Apple, offered monthly or annually, and it may begin with a free trial.
During the closed beta nothing can be bought. The membership screen is visible so that we can test it, but purchasing is switched off, and every tester has access to whatever the build contains.
When the membership does go on sale, these terms apply to it:
- The price is the one Apple shows you at the moment of purchase, in your own currency, including any tax. We do not quote prices here because they change by country and over time.
- It renews automatically at the end of each period, and Apple charges the Apple Account you bought it with, unless you turn renewal off at least 24 hours before the period ends.
- A free trial, where offered, converts into a paid period unless you cancel before it ends. Cancel at least 24 hours before the trial finishes and you will not be charged.
- You manage and cancel it in your Apple Account settings, not in our app, because Apple holds the subscription. Deleting the app does not cancel it.
- Cancelling stops the next charge. It does not shorten the period you have already paid for, and it does not by itself produce a refund.
- Refunds are Apple's to give. Ask Apple through its own refund process. If you are a UK consumer, your statutory rights are unaffected, including your right to cancel a digital purchase within 14 days where that right applies, and we will not stand in the way of a fair refund.
- We may change what the membership includes, or its price, for future periods. We will tell you before a change takes effect, and you can cancel rather than accept it.
- Only an adult may buy. The purchase screen sits behind a parental gate, and you are responsible for the device settings that stop a child buying anything, including Apple's Ask to Buy and in-app purchase restrictions.
We never see your card. Payment happens entirely inside Apple's checkout. We use RevenueCat to tell the app whether this device has a membership, and our Beta Privacy Policy describes exactly what that involves.
6. Using it properly
Please do not:
- copy, sell, rent, lend, sublicense or distribute the app or any part of it;
- reverse engineer, decompile, disassemble, modify, or create derivative works from it, or extract its artwork, characters, audio or code, except so far as the law expressly permits despite this sentence;
- remove or obscure any copyright, trade mark or other proprietary notice;
- use the app, or anything in it, to train a machine learning or artificial intelligence system;
- use it in any commercial setting, including nurseries, schools, clinics and childminding, without our written agreement;
- circumvent any technical restriction, or use the app in a way that breaks the law or infringes someone's rights.
We may suspend or end your licence if this is ignored.
7. Who owns what
The app and everything in it, including the code, artwork, characters, dinosaurs, worlds, music, sound effects, words, look and feel, belongs to Brightlobe or is used by us with permission, and is protected by copyright, trade mark and other laws. Nothing in these terms transfers any of it to you.
You may show the app to friends and family, and talk about it freely once it is publicly released. During the closed beta, section 6 of the Beta Testing Terms asks you to keep it to yourself.
8. It is a game, not a programme of instruction
We design Little Stomp Club so that play and learning sit in the same place, and we talk about the thinking behind it on our website. That is a description of our design approach, not a clinical claim.
The app is not an educational curriculum, a teaching method, a developmental or diagnostic assessment, a therapy, or medical, psychological or educational advice, and it is not a substitute for any of them. We make no promise about what any individual child will learn, achieve, or do. If you have a concern about your child's development, speak to a health visitor, GP, teacher or other qualified professional.
9. Your responsibility as the grown-up
You are responsible for your child's use of the app, for supervising play, for how long it goes on, and for the device itself, including its settings, parental controls and everything else installed on it. Please take normal sensible precautions: sit with a young child, keep sessions short, take breaks, and stop if your child is tired, distressed or unwell.
A small number of people can have seizures triggered by flashing lights or patterns, even with no history of epilepsy. If your child experiences dizziness, altered vision, twitching, disorientation, convulsions or loss of awareness while playing, stop at once and consult a doctor.
10. Updates, changes and availability
We may update the app, change or remove features, or stop supporting older devices or operating system versions. We may stop distributing or supporting the app entirely, in which case we will give reasonable notice where we can. Your device or app store may install updates automatically depending on your settings.
We do not promise the app will always be available, uninterrupted or free of faults, and we do not promise your saved progress will survive an update, a device change, or a reinstall.
11. What we do and do not promise
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, your statutory rights are not affected, including your rights under the Consumer Rights Act 2015 for digital content that is not of satisfactory quality, not fit for purpose or not as described, and, in the United States, any rights under the laws of your state that cannot be waived.
Subject to that, and to the fullest extent the law allows:
- the app is provided "as is" and "as available", with no warranties of any kind, express or implied, including implied warranties of satisfactory quality, merchantability, fitness for a particular purpose and non-infringement;
- we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of data or lost game progress, or for any loss arising from your device, its settings, or software we did not write;
- where we are liable to you despite the above, our total liability under these terms is limited to the greater of the amount you paid us for the app in the twelve months before the claim, and £100.
You agree to be responsible for any claim brought against us that arises from your deliberate misuse of the app or your breach of section 6, except so far as we are at fault. Nothing in this paragraph applies to you as a consumer beyond what the law allows.
12. Apple
Where you obtain the app through the App Store or TestFlight, the following apply and prevail over anything inconsistent elsewhere in these terms:
- These terms are between you and Brightlobe only, not with Apple. Brightlobe, not Apple, is solely responsible for the app and its content.
- Your licence to use the app is limited to a non-transferable licence to use it on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that it may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Apple has no obligation whatsoever to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation of any kind, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are Brightlobe's responsibility.
- Brightlobe, not Apple, is responsible for addressing any claim by you or a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy or similar legislation, including in connection with the app's use of any framework.
- If a third party claims the app or your possession and use of it infringes their intellectual property rights, Brightlobe, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent and warrant that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties. You must comply with all applicable third-party terms when using the app.
- Apple and Apple's subsidiaries are third-party beneficiaries of these terms and, on your acceptance, will have the right to enforce them against you as a third-party beneficiary.
- If the app is acquired by or on behalf of the United States Government, it is "commercial computer software" and "commercial computer software documentation" as those terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, and is licensed with only those rights granted to all other end users under these terms.
Any questions, complaints or claims about the app should go to hello@brightlobe.com, not to Apple.
13. Ending it
You can end this agreement at any time by deleting the app. We can end it if you materially breach these terms, in which case your licence stops and you must delete the app from every device. Sections 7, 8, 11, 12 and 14 survive.
14. General
- Changes. We may update these terms; the date at the top changes when we do. If a change is significant, we will bring it to your attention through the app, the App Store listing or by email. Continuing to use the app means you accept the current version.
- Transfer. You may not transfer your rights under these terms. We may transfer ours to a company taking over our business, provided your rights are not reduced.
- Severability and waiver. If part of these terms is unenforceable, the rest continues. If we do not enforce something immediately, we may still enforce it later.
- Whole agreement. These terms, together with the Beta Privacy Policy and, during the beta, the Beta Testing Terms, are the whole agreement between us about the app.
- Third parties. Nobody other than you, us and Apple, as set out in section 12, has any right to enforce these terms.
15. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you may bring proceedings in your own jurisdiction. If you are a consumer resident in the United States, nothing here deprives you of the protection of the mandatory consumer laws of your state of residence, or of your right to bring a claim where those laws allow.
